PROBLEM/ISSUE STATEMENT
High Sierra II, Inc. is splitting off a tract from Certificate of Survey 2017. This tract is to continue to be utilized as agriculture land. In order for the subdivision plat to be exempt from subdivision review, it is necessary to approve a Declaration of Agricultural Covenant. This will be between the City of Billings and Dover Ranch. If this tract is to be developed in the future, it will need to go through the subdivision process.
ALTERNATIVES ANALYZED
The Council may:
- Approve the Declaration of Agricultural Covenant; or,
- Disapprove the Declaration of Agricultural Covenant. The land is currently used as agricultural land and will be in the future.
FINANCIAL IMPACT
There is no financial impact with approval of the Declaration of Agricultural Covenant.
RECOMMENDATION
Staff recommends that the City Council approve the Declaration of Agricultural Covenant.
