W.O. 16-03, Contract #1 is part of the 2016 Street Maintenance Program, specifically the City Crack Seal contract.  Annually, staff identifies streets proposed for preventative maintenance. Staff bids this work in three contracts: chip seal resurfacing, overlay resurfacing and crack sealing. This contract will provide crack sealing on approximately 25 miles of streets. The project was advertised on September 24th, October 1st and October 8th in the Billings Times and on the City's website and bids were opened October 13th.  Due to the Columbus Day holiday, the City Council meeting is on the same day as the bid opening and state law requires that Council act on a bid opening at the next Council meeting.  Staff requests that the bid award be delayed to allow time to review the bid results.

There are no viable alternatives to delaying award because bids were opened the same day as the Council meeting and staff has not had sufficient time to review the bids and compliance with all bidding requirements.

Funding for Work Order 16-03 Contract #1 City Crack Seal is included in the FY 16 budget.  The project was bid on October 13th and the results of that bid will be presented for award recommendation at the October 26, 2015 City Council meeting.

Staff recommends that Council delay award of a construction contract for Work Order 16-03 Contract #1 City Crack Seal until the October 26, 2015, Council meeting to give staff time to review the bids.
