PROBLEM/ISSUE STATEMENT
On March 29, 2016, the Planning Division received an application for preliminary plat approval for the 23rd Street Subdivision, Amended Plat of the North 100’ of Lot 1, Block 8 of Sunnyside Subdivision, Second Filing. This subdivision is reviewed as a subsequent minor plat through the minor plat review process. The lot currently has one four-plex dwelling and a new multi-family dwelling is proposed for the second parcel. The owner is Mark Wright. The representing agent is Territorial Landworks, Inc.
ALTERNATIVES ANALYZED
In accordance with state law, the City Council has 35 working days to act upon this subsequent minor preliminary plat. The 35 working day review period for the proposed plat ends on May 16, 2016. State and City subdivision regulations also require that preliminary plats be reviewed using specific criteria, as stated within this report. The City may not unreasonably restrict an owner’s ability to develop land if the subdivider provides evidence that any identified adverse effects can be mitigated. Within the review period, the City Council is required to:
- Approve
- Conditionally Approve;or
- Deny the Preliminary Plat
FINANCIAL IMPACT
Should the City Council approve the preliminary plat, the subject property may further develop under private ownership, resulting in additional tax revenues.

STAKEHOLDERS
A public hearing is not scheduled for the City Council meeting, however nearby property owners may attend the City Council meeting. The Planning Division has received no public comments or questions regarding the proposed subdivision.

Consistency with the 2008 City of Billings and Yellowstone County Growth Policy, the 2014 Transportation Plan Update, the 2011 Billings Area Bikeway and Trail Master Plan, and the North Park Neighborhood Plan are discussed within the Findings of Fact.
