PROBLEM/ISSUE STATEMENT
Popelka Enterprises had petitioned to vacate a portion of Montgomery Street near Hansen Lane. The property owner is proposing to re-develop the area and the Montgomery Street right of way will be utilized in their development. Montgomery Street only extends a short distance south of Hansen Lane and appears to be a driveway into the Albertsons. Since the street cannot be extended in the future, there is no need to have this portion of street. There is a sanitary sewer main in Montgomery, and it will remain in place and the city will have the same access to it as today per state law. The area of the right of way proposed to be vacated is 3,900 square feet.
ALTERNATIVES ANALYZED
The Council may:
- Approve acknowledgment of petition to vacate the above-mentioned right-of-way and set a public hearing for June 13, 2016; or
- Do not acknowledge the petition and terminate the right-of-way vacation process.
FINANCIAL IMPACT
George Warmer from Coldwell Bankers has established value of the right of way at $5.05 per square foot. The total value of the right of way is $19,695.
RECOMMENDATION
Staff recommends City Council acknowledge the receipt of a petition to vacate a portion of Montgomery Street and set a public hearing for June 13, 2016.
