PROBLEM/ISSUE STATEMENT

Staff opened bids on April 26, 2016, for W.O. 16-06 South Billings Urban Renewal District (SBURD) Sanitary Sewer, Phase 2. The contract was advertised on April 7th, 14th, and 21st in the Billings Times and on the City's website.  Six bids were submitted.

A public agency in Montana shall award a public contract for construction, repair, and public works to the lowest responsible bidder without regard for residency.  However, a Montana resident bidder must be allowed a preference against the bid of a nonresident bidder from any state or country that enforces a preference for resident bidders.  The preference given to Montana resident bidders must be equal to the preference given in the other state or country. See §18-1-102(1)(a), MCA. 
 
Wyoming’s bid preference statute provides that Wyoming resident bidders will receive preference over nonresident bidders if the nonresident bid is not more than 5% lower than the lowest resident bid.  Therefore, although Wyoming’s nonresident bidder (Wilson Bros. Construction, LLC) submitted the lowest construction bid and would otherwise be awarded the project, its nonresident bid is not more than 5% lower than the lowest Montana resident bidder (COP Construction LLC). In this case, Wilson Bros. Construction was only 3.6% ($26,190.50) lower than COP Construction LLC. Therefore, the City must award this construction contract to the Montana resident bidder, COP Construction LLC.

After considering preference to resident bidders, COP Construction LLC submitted the lowest responsible bid. 

This project will construct approximately 3,400 lineal feet of new sewer in areas where there currently is none. The area is bounded north-south by Morgan and Francis Ave and bounded east-west by Jackson St and Hallowell Ln.  New mains and sewer service connections to property lines will be installed. The project was bid with one alternative. Add Alternative A is 611 lineal feet of new sewer main which is part of the 3,400 lineal feet but was contingent on obtaining an easement from a property owner at 146 Jackson St. An easement agreement has been signed at no cost to the City and will be presented to Council for approval on May 23.

This project will provide the opportunity for properties in the area to connect to sanitary sewer but the property owners will not be required to connect to sewer unless their septic system fails.
 

ALTERNATIVES ANALYZED

The Council may:
  • Award W.O. 16-06 to COP Construction LLC in the amount of $729,600.00; or
  • Not award the contract to COP Construction LLC and reject all bids.  If the contract is not awarded, property owners within the project area will not be able to connect to the City sanitary sewer.
