PROBLEM/ISSUE STATEMENT

The final plat for the Amended Lot 22A of Pemberton Subdivision is being presented to City Council for approval. On July 11, 2016, the City Council preliminarily approved this plat which will create 3 lots from a 1.4 acre parcel of land.  The parcel is generally located on the north side of North Lakeview Drive in the Billings Heights.  The subject property is legally described as Lot 22A of the Amended Plat of Lots 21 and 22 of Pemberton Subdivision, Lot 1, and is zoned Residential 6000.  Residential 6000 requires a minimum lot size of 6,000 square feet and allows single family and multi-family dwellings to be built on each lot.  The owner is Melodee Haagenson, et al. and the representing agent is Pinpoint Land Surveys.  Upon City Council approval, these documents are appropriate as to form for filing with the Clerk and Recorder.

ALTERNATIVES ANALYZED

The City Council may approve or deny the final plat of Amended Lot 22A of Pemberton Subdivision. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in MCA 76-3-611 and BMCC Section 23-307.

FINANCIAL IMPACT

Should the City Council approve the final plat, the newly created lots may be sold separately and developed, increasing the tax and assessment revenues for the City while also generating service demands.

RECOMMENDATION

Staff recommends that the City Council approve the final plat of Amended Lot 22A of Pemberton Subdivision.
