PROBLEM/ISSUE STATEMENT
The City Council approved a Ballpark Management, Operation and Use Agreement for Dehler Park with Mustangs Baseball, LLC, on April 24, 2017. Section 28.2 Regulated Transactions, says the Agreement constitutes a "Regulated Transaction" under Major League Rules that must be disclosed to Baseball Authorities and "shall not be effective until disclosed in accordance with Rule 54(a)(3)(C) and found to be in compliance with the Baseball Rules in all respects."
The agreement was reviewed by the Pioneer League President and Minor League Baseball officials, who requested the following changes:

- In Section 1.4 Ballpark Permanent Fund, the phrase "shall be a permanent fund" to "is a permanent fund" to make clear it already is in effect and to make it consistent with Section 6.2, Capital Replacement, Repairs and Improvement Fund, which states that the fund is permanent.
- In Section 1.6 Baseball Authorities, to change the phrase, "the Office of the Baseball Commissioner" to the accurate title, which is "the Baseball Office of the Commissioner."
- In Section 1.21, removing the words "a non-profit corporation and..," since the Pioneer League is not non-profit.
ALTERNATIVES ANALYZED
City Council may:
- Approve the amendments, completing the contract approval; or,
- Postpone action on the amendments; or
- Disapprove the amendments, creating a need for additional negotiations.
FINANCIAL IMPACT
There should be no financial impact from making the requested changes.
RECOMMENDATION
Staff recommends that the City Council approve the three described amendments to the Mustangs Baseball, LLC agreement.
