PROBLEM/ISSUE STATEMENT
Pro Auto Sound & Security is appealing the Police Department's denial of a waiver from the noise ordinance limits for a sound competition from 10 a.m. to 6 p.m. Saturday, June 24, 2017, in its parking lot at 2271 Eldorado. Cars would test their sound system for 30 seconds at a time. during the event.
This permit is being denied because the location is adjacent to a residential area, and the City received multiple complaints during last year's event. BMCC Sec. 17-106 (b) (7) Waiver, requires consideration of "the distance of the proposed activity from residential housing or other noise sensitive properties."
BMCC Sect. 17-06 (c) allows any applicant denied a waiver to appeal the denial to the City Council. Attached is a letter from Jarrett Warner of Pro Auto regarding the appeal.

RECOMMENDATION
Staff recommends the City Council uphold the denial.
