Title: Preliminary Plat Extension Request for Amended Lot 1, Block 1, Bishop Fox Subdivision

RECOMMENDATION

City Staff recommends approval of the requested extension for the preliminary plat of Amended Lot 1, Block 1, Bishop Fox Subdivision.

BACKGROUND (Consistency with Adopted Plans and Policies, if applicable)

On October 21, 2021, Cushing Terrell submitted a request for an extension to the preliminary plat of Amended Lot 1, Block 1, Bishop Fox Subdivision.  They are requesting an additional two years of preliminary plat approval for this subsequent minor subdivision.  There are items related to the conditions of preliminary plat approval and SIA requirements that the property owners plan to address and complete before final plat approval and execution of the SIA. This extra time will enable them to complete the items.

The subdivision was preliminarily approved on January 23, 2017, and originally would have expired on January 23, 2020. An extension was requested and granted on September 23, 2019, for two years. The two-year extension request extended the expiration date out to January 23, 2022. They are requesting an additional 2-year extension. If the new extension request is approved, the preliminary plat will expire January 23, 2024. More than one extension is allowed as outlined in the City of Billings Subdivision Regulations, Section 23-303 I. 

I. Preliminary Plat Approval Period. The approval or conditional approval shall be valid for not more than three (3) calendar years. At the end of this period the governing body may, at the request of the subdivider, extend its approval for a mutually agreed-upon period of time. Any mutually agreed-upon extension must be in writing and dated and signed by the governing body and the subdivider or subdivider’s agent. The governing body may issue more than one extension.

This subdivision is located on the northeast corner of the intersection of 54th Street West and Grand Avenue. The property is zoned CMU2-Corridor Mixed Use 2 and is proposed for commercial development. The materials for the extension request were sent out to different divisions within the City to obtain comments or concerns with the extension request.  City Fire, Engineering, Public Works and Planning all reviewed the request and there were no concerns with the requested extension. The review criteria for the extension request is provided as an attachment to this report.

ALTERNATIVES

The City Council may, Approve or Disapprove the request for extension. Disapproval would require City Council to review and make its own determinations using the extension criteria attached to this staff report.

FISCAL EFFECTS

This extension request will have no direct financial impact on the Planning Division.
