PROBLEM/ISSUE STATEMENT
The final plat for Kuhlman Subdivision, Amended Lot 7 is being presented to Council for approval. On November 12, 2010, City staff held a pre-application with the applicant to discuss the creation of a two-lot subdivision of 19,945 square feet of land. It was determined at that time that the subdivision qualifies for the expedited plat review process, which allows, under certain conditions, subdivisions creating just two lots to proceed straight to final plat review. The subject property is located on the west side of Main Street, between Josephine Drive and Kuhlman Drive. It is zoned Highway Commercial (HC) and there are two existing residences on the property. The proposed subdivision would situate one resident on each lot. One variance has been requested from Section 23-406(B)(6) of the City Subdivision Regulations. The variance would allow the required right-of-way dedication for Kuhlman Drive to be reduced (see Attachment 2 for further details). The subdivider is Optionen, LLC, Dieter Zimmermann, Member, and the agent is Pinpoint Land Surveys, PLLC. Upon City Council approval, these documents are appropriate as to form for filing with the Clerk and Recorder.
ALTERNATIVES ANALYZED
The City Council may approve or deny the final plat of Kuhlman Subdivision, Amended Lot 7. If the City Council chooses to deny the final plat, it must base the denial on the criteria outlined in MCA 76-3-611 and BMCC Section 23-305(F).
FINANCIAL IMPACT
Should the City Council approve the final plat, the creation of an additional residential lot may result in an increase in property tax revenues.
RECOMMENDATION
Staff recommends that the City Council approve the requested variance from Section 23-460(B)(6), BMCC, and approve the final plat of Kuhlman Subdivision, Amended Lot 7.
