Ammendment to original IGA removing specific language reference cross certification of Border Patrol Agents
Information
Agenda Item Text:
Approve amendment to Border Crimes Unit Intergovernmental Agreement (IGA) wherein parties wish to maintain the terms and conditions of the original IGA in all regards except to remove language which refers to deputizing Border Patrol Agents with Peace Officer status.
Background:
July 15, 2013 Cochise County and USBP entered into IGA reference the border crimes unit. A collaborative effort of the Cochise County Sheriff's Office and USBP to enhance law enforcement services as pertains to crimes occurring within the county and which have a nexus to the border. Since entering into this agreement, discussion reference the need to cross certify "deputize" border patrol agents, as stated in original IGA, has occurred. It is the decision of the Sheriff that cross certifying border patrol agents is not critical to the mission of the border team, and therefore, cross certification will not be given by the Sheriff. It is the Sheriff's request that the original IGA be amended to reflect that cross certification "deputizing" of border patrol will not be performed and remove that language through the amendment:
Wherein parties wish to maintain the terms and conditions of the original IGA in all regards except one sentence contained in section 1. Participation. The parties wish to delete in it's entirety the second sentence contained in section 1. Participation which reads as follows "said agents shall be deputized with "peace officer" status by the Cochise County Sheriff, pursuant to ARS 11-441 and ARS 13-3875.
