Adopt Resolution 13-32 to approve a Residential Anti-Displacement and Relocation Assistance Plan for FY 2013.
Background:
Section 104(d) of the Federal Housing and Community Development Act of 1974 requires that each applicant for Community Development Block Grant (CDBG) funds must adopt, make public, and certify that it is following a Residential Anti-Displacement Plan.
The Plan, administered out of the Cochise County Housing Authority, in conjunction with the Cochise County Grants Administrator, requires that certain steps be followed prior to obligating or expending CDBG funds that will directly result in the demolition or conversion of vacant habitable low/moderate income dwellings.
When a proposed CDBG project could result in direct or indirect involuntary displacement of community residents (including businesses), the applicant must prepare a plan which describes the actions to be taken to assist such persons to remain in their neighborhoods, when they prefer, to provide equitable and reasonable benefits to those persons who will be involuntarily and permanently displaced.
Assistance provided under the Plan requires the County to:
Coordinate code enforcement with rehabilitation and housing assistance programs.
Provide temporary facilities to house persons during rehabilitation.
Provide counseling and information to homeowners and tenants about assistance available to help them remain in their neighborhood in the face of revitalization pressures.
This assistance is solely related and dependant on projects that utilize CDBG funds to demolish or convert low/moderate income housing units. This Anti-Displacement plan must be adopted every 5 years to be eligible to continue receiving CDBG funding. and comply with Federal mandate. The County has previously adopted this Resolution.

Department's Next Steps (if approved):
Forward Resolution to the Arizona Department of Housing. Monitor any potential CDBG projects along with the Housing Authority to ensure compliance. Track the 5 year time frame to renew Resolution.
Impact of NOT Approving/Alternatives:
We will be out of compliance with Federal Housing regulations specifically Section 104(d) of the Housing and Community Development Act of 1974. Failure to adopt a Resolution could result in loss of CDBG funding
