Approve an Intergovernmental Agreement (IGA) between the City of Tombstone and the County of Cochise for setback inspections from the Tombstone Aqueduct.
Background:
A reservoir and pipeline/aqueduct were constructed in 1882 by the Huachuca Water Company to deliver water from the Miller Canyon area in the Huachuca Mountains to the Tombstone Reservoir for the City of Tombstone. The aqueduct was a major factor in the growth of Tombstone, which at the time was hampered by a lack of water.
The aqueduct is approximately twenty-four miles in length, with a branch of the aqueduct running from Carr Canyon in the Huachuca Mountains for approximately 3 ½ miles; they meet approximately halfway between Hereford Road to the south and Ramsey Road to the north. The aqueduct currently starts at a fenced-in spring just upstream from the old Pamerlee town site (which was located in the Coronado National Forest about 12 miles west of Hereford).
The City of Tombstone requests the services of the County Building Division to provide setback inspections from the Tombstone Aqueduct. These inspection requests are originated by the property owner as prescribed on the permit issued by the County where the conditioned setback requirements are noted. The inspections are to be performed by qualified County personnel. The services to be provided by the County shall be limited to visual inspection of setbacks determining compliance with the conditioned setback requirement.
The City will compensate the County for such services at the rate of fifty dollars ($50.00) per hour, to be prorated to the nearest tenth of an hour as assessed by the County. The City will also in addition to the hourly rate, include 10% of the hourly cost as an administrative fee. The City will make all such payments within thirty (30) days of the receipt of an itemized bill for authorized services.

Impact of NOT Approving/Alternatives:
The provision of these inspections not only helps the City of Tombstone in protecting their assets, it also ensures a more coordinated development process. Since building inspectors will be on these properties anyway conducting other inspections, providing this service will pose minimal impacts on Building Division operations.
