Approve Docket SUA-11-01 (Douglas), an appeal of the Planning Commission's February 9, 2011 approval of Docket SU-11-01 (Ballator).
Background:
Docket SUA-11-01 (Douglas): On February 9, 2011, the Planning and Zoning Commission authorized a Special Use for a Nature Exhibit, per Section 607.31 of the Zoning Regulations. The conditional approval by the Commission legitimized an existing birdwatching exhibit in Ash Canyon. The Appellant seeks to overturn the Commission approval, by appealing Docket SU-11-01 to the Board of Supervisors.
The parcel that is the subject of the Commission decision and subsequent appeal (Parcel No. 104-21-022) is located 5255 E. Spring Road in Hereford, AZ. The Appellant is Arthur Douglas.

Department's Next Steps (if approved):
If approved, the Board action would overturn the Planning and Zoning Commission approval of Docket SU-11-01, which legitimized an existing bird-watching operation assciated with the Ash Canyon Bed & Breakfast. The B&B would remain open, but the propriator would no longer be allowed to open her yard to birders not staying at the B&B.
Impact of NOT Approving/Alternatives:
If the Board denies the appeal, the Planning Commission's conditional approval would be upheld, and the Applicant, Mary Jo Ballator, would be allowed to proceed through the commercial permitting process. The Community Development staff would apply the conditions imposed by the Commission during this process.
