Approve a request from Joe Schneider for a waiver of right-of-way permit fees totaling $750 for final road work on the Sonora Verde Estates Subdivision, Phase III.

Background:

Mr. Joe Schneider, developer of the Sonora Verde Estates Subdivision, is requesting a waiver of the $750.00 right of way permit fee for the final phase of construction on this development.  The subdivision is located northeast of Benson in Pomerene.  Below is Mr. Schneider's request and Highway & Floodplain's recommendation that the waiver not be granted.

Good Morning Frances, It was really nice speaking with You and Mr. Ron the other day. I am writing this Letter to request a Full or Partial Waiver of the ROW fee on the remaining 700+/- feet left on the Sonora Verde Estates Sub-Division. As we know the Property has lost most of it's value, and I have been and am currently trying to find a Lender/Investor to finish the Project. Thankfully, the "heavy-lifting"/costs are completed. A potential Lender will loan (literally) to the dollar the "hard costs" that need to be finished. Pomerene Water District and Sulphur Springs are being very helpful, as well as vendors/contractors. They do not want to see the Project abandoned, and another "black-eye" for the area. Our Development is "Pride of Ownership" and our Residents are the type and quality we desire AND need for our County. Besides major health issues, I have suffered total financial destruction. We made a major Investment in the County (lost it), but still strongly believe in the people and future of the area. The last thing we all need is a Legal/Media "nighmare" if the Sub-Division is abandoned. Any help the County could provide to complete the last Phase would be most appreciated. Highway & Floodplain recommendation against approval:

As County Engineer I do not recommend a waiver of the ROW fees. The Highway Division has helped Mr. Schneider for many years in the development of this subdivision as we were able to justify. We have also had to expend funds on multiple occasions to deal with drainage and erosion problems from the undeveloped portion of the subdivision.

 If the fee waiver is approved, the Department will process the right of way permit without fees.

Impact of NOT Approving/Alternatives:

The Applicant will be required to pay the $750.00 fee prior to commencing construction.
