Agenda Item Text:

Approve Grazing License with Lazy H Slash, LLC for the Three Canyons/Palominas Parcel owned by the Flood Control District effective July 1, 2014 for a term on one year with automatic six month renewals unless canceled by either party.

Background:

In 2013, the Flood Control District purchased a 480 acre parcel in the Palominas area commonly referred to as the Three Canyons/Palominas parcel. The District may eventually use the parcel for flood control and recharge, and also may sell out parts of it. Meanwhile, the District wants to continue licensing the parcel to Lazy Slash H, LLC, which has been leasing the parcel for grazing livestock for many years. The terms of the attached Grazing License calls for Lazy Slash H, LLC to maintain the parcel and improvements in return for the license to graze.  Supervisor Searle negotiated the annual grazing fee, which is $2,400 per year, but can be adjusted up or down depending upon the actual amount of animal unit months used by the Licensee.

The license to graze is not exclusive; thus, the District can use the parcel for other purposes that are compatible with grazing. The term of the license is for one year, with automatic six month renewals unless either party specifically cancels the lease in advance of the renewal period.

Department's Next Steps (if approved):

None

Impact of NOT Approving/Alternatives:

The parcel will not be used for grazing and the County will forego $2,400 per year in revenue.
