Adopt Resolution 11-16 in accordance with A.R.S. 48-901 et. seq., approving the establishment of the Topaz Domestic Water Improvement District as described in the attached Petition, including Exhibits A-F and appointing Alan Thome, Walt Thome and Marty Schwank to serve as the initial governing board.
Background:
The Petition to form the Topaz Domestic Water Improvement District (Topaz Domestic WID) has been signed by the property owners of all the property in the proposed district who, in conformance with the provisions of the A.R.S., have waived their right to a public hearing, etc. This proposed water district is in conjunction with the Copper Hills Conservation Subdivision Tentative Plat, Docket S-10-02, which was approved by the Board at their meeting on December 14, 2010, with conditions, including that a water district be formed to provide service to future residents.
A.R.S. allows the board to summarily order the establishment of a district in such cases. The Election & Special Districts' Director, Tom Schelling, the Deputy County Attorney, Terry Bannon and the Clerk of the Board, Katie Howard, have each reviewed the Petition, together with its attached Exhibits A-F, and also reviewed the applicable statutes and jointly recommend the approval of this request.
