Approve the Arizona Technical Assistance Panel Agreement with the Urban Land Institute (ULI) to convene a panel of land law experts, at no charge, to discuss the long term implications of open space in subdivisions for an amount not to exceed $5,000.
Background:
The Urban Land Institute (ULI) is a 501[c][3] nonprofit research and education organization. The mission of the Urban Land Institute is to provide leadership in the responsible use of land and in creating and sustaining thriving communities worldwide. ULI Arizona has been a statewide convener for dialog among industry leaders, providing an unbiased and non-partisan exchange of ideas relevant to Arizona communities and local government since 1980.
ULI has obtained funding from Union Pacific Building American Foundation to conduct various Technical Assistance Panels around the state for the purpose of benefiting the general public and policy makers through improved planning and land utilization. There is no county match and the county will receive no direct funds for this program. There is no cost to the County to put on the half-day discussion that will be held in Cochise County.
The issue presented last year for their consideration was “open space”. The panel will consist of experts in the fields of land use and law, legal planning, and redevelopment. Conversation will include, among other things, what happens when a homeowners association (HOA) disbands and who takes care of or what happens with open space that is tied to the plan. Open space could be important for floodplain management issues, including flood insurance rates for the entire County. Other issues include maintenance of any common areas including drainage basins and structures. This is an attempt to get ahead of an issue that will cause concern in the future for planning and zoning of subdivisions. ULI’s committee indicated this should be of concern for most western states and hasn’t been addressed yet in our area.
It will be a community effort with statewide participation. Other counties and gov’t stakeholders as well as residents, developers, and conservation groups from Southern Arizona will participate in the discussion. Local experts will also have the opportunity to serve on the panel.
Department's Next Steps (if approved):
Return the signed contract to ULI and continue staff preparations for the panel discussion to be held in June 2015.
Impact of NOT Approving/Alternatives:
If this Grant Agreement is not approved, the County will lose the opportunity to participate in the program and would not benefit from the free use of time for experts in land use and development. Considerable time would be lost as this project has been under development by staff for a year.
