Approve the Arizona Automobile Theft Authority Grant Agreement, Vertical Prosecution Program Fiscal Year 2011, between the Arizona Automobile Theft Authority and the Cochise County Attorney's Office from March 18, 2011 to June 30, 2011 in the amount of $11,140.
Background:
From 2003 through 2009 we received grant funding from the Arizona Auto Theft Authority. These awards were focused on vertical prosecution, one attorney in the office was funded solely to prosecute auto theft cases. We were not awarded funding for 2009-2010 or 2010-2011. In March of this year the Arizona Automobile Theft Authority contacted us to offer grant money for us to prosecute auto theft cases. With implementation of the Early Resolution Court, the vertical prosecution concept does not fit. Therefore, the Auto Theft Authority modified their requirements to allow us to prosecute auto theft cases through the Early Resolution Court process and agreed to fund one prosecutor at 50% from March 18, 2011 to June 30, 2011.
Dan Akers, Attorney II, will be the assigned prosecutor under the grant at 50%. He is currently funded 45% from the general fund and 55% from the Criminal Justice Enhancement funds (Fund 136).
Since we received the grant funding from Mr. Akers for March 18, 2011 to June 30, 2011, we will reimburse the general fund for his salary for this period. We will be applying for funding for the next FY at 50% for the whole year and change Mr. Akers funding accordingly.

Department's Next Steps (if approved):
Arizona Automobile Theft Authority is providing funding in the amount of $11,140.00, which will fund 50% of Dan Aker’s salary and EREs for the period March 18, 2011 thru June 30, 2011, generating a savings to the general fund.
Impact of NOT Approving/Alternatives:
The general fund would continue to fund 45% of Mr. Aker’s salary.
