Approve professional services contracts with Ruben Teran, Esq. and Laura Udall, Esq. for the representation of defendants charged with capital murder

Background:

IDC is requesting approval of professional service contracts with court-appointed attorneys representing co-defendants in a capital murder case.  Ruben Teran, Esq. has been appointed to represent defendant Robert Sappington, and Laura Udall, Esq. has been appointed to represent defendant Jarod Larson.  IDC currently provides payment to court-appointed attorneys in accordance with Cochise County Superior Court Administrative Order 2008-26 (attached) and does have formal contracts with the attorneys.  IDC believes that professional services contracts are appropriate for this serious case.

Department's Next Steps (if approved):

If approved, IDC will reimburse attorneys for time and expenses in accordance with the contract. 

Impact of NOT Approving/Alternatives:

If not approved, IDC will reimburse attorneys for time and expenses based on Court orders and without a written agreement between the attorneys and the County.

IDC anticipates costs for the two cases will total approximately $2,000,000. Costs will be ongoing beginning in FY1011 and continuing through FY11/12 and possibly FY12/13.
