Agenda Item Text:
Approve Intergovernmental Agreement (IGA) with the City of Bisbee for Legal Services for the period of July 3, 2017 to June 29, 2019.
Background:
The City of Bisbee has been contracting for a part time City Attorney but has voted to terminate that contract. The City has asked the County Attorney if we can provide City Attorney services. Pursuant to A.R.S. § 11-532(E), the County Attorney can provide legal services to another political subdivision through an IGA.
We told Bisbee that while we would be pleased to do so, we don't have extra attorney time to spare, and thus to provide such services we would need to add a position.
Bisbee has budgeted $60,000 for this position. That would not be sufficient to hire an attorney. However, it would be enough to hire an additional Paralegal III or Legal Secretary III, either of whom could take a load off the three Civil Division Attorneys. We believe hat would free time to enable us to provide legal services.
The $60,000 would cover salary for either position, EREs including health insurance, and one-time costs for a computer, software and a telephone, with enough left over for office supplies and other miscellaneous costs.
We also informed Bisbee that because we were hiring a position based on this funding, we would require a two year term with a 120 day intent not to renew. These terms are included in the IGA that is attached to this agenda item.
As structured, we believe that this IGA will be beneficial to Bisbee, the County Attorney and the County. We are recommending approval.
Because the Paralegal III or Legal Secretary III are new positions, the Board would need to approve those positions. That is the subject of a related agenda item.
