Approve the Intergovernmental Agreement (“IGA”) with the Whetstone Fire District for the County Attorney's Office to provide legal services effective upon the Board’s approval with an automatic annual renewal option.
Background:
The Whetstone Fire District (“WFD”), a political subdivision of Cochise County, recently requested to renew its IGA with the County Attorney’s Office (“CAO”) in which the CAO will provide the WFD with legal representation. Pursuant to A.R.S. § 11-532(E), the County Attorney can provide legal services to another political subdivision through an IGA.
The agreed-upon rate is $75 per hour for attorney time spent on representing WFD and $38 per hour for paralegal time. Billing shall accrue quarterly, with statements sent in January, April, July, and October. Payment is due within thirty (30) days of the billing date.
The contract would commence from one year from the date that this IGA is approved by all parties, and shall thereafter automatically renew for successive one year periods; provided, however, that either party may terminate this Agreement with or without cause upon thirty (30) days’ written notice.

Department's Next Steps (if approved):
If approved, the County Attorney will continue to provide legal services for the Whetstone Fire District.
Impact of NOT Approving/Alternatives:
The Whetstone Fire District would have to find another source of legal services.
