Agenda Item Text:

Approve the City of Tucson High Intensity Drug Trafficking Area (HIDTA) Grant Agreement (Cycle 21) in the amount of $229,335 between the City of Tucson and Cochise County for the period January 1, 2011 through December 31, 2012.

Background:

The HIDTA Grant funds two drug crime attorneys and two legal secretary seniors in the Cochise County Attorney’s Office. The HIDTA Grant allows prosecutors funded with this grant to prosecute drug crimes. By not renewing the grant the County will lose two experienced senior prosecutors and two legal secretary seniors. The County Attorney’s Office will have to reduce the number of drug crime prosecutions and asset forfeiture seizures due to a lack of manpower. If the County were to pay for these personnel out of the general fund, tax payers will assume the added expense. The county attorney’s office is mandated to prosecute crimes.

The question is whether the Board wishes to decline HIDTA Grant funding and eliminate the four positions currently funded by the HIDTA Grant; or decline the grant and pay the four positions out of the general fund; or accept the grant and absorb the overhead costs associated with the grant.

This grant works in conjunction with the Cochise County Sheriff’s HIDTA and the Border Alliance Group. Not renewing this grant it would jeopardize law enforcement drug grants and the Byrne grant.

Fiscal Impact & Funding Sources: Funding of 2 prosecutors and 2 support staff personnel with no impact to the general fund and continue with drug prosecutions in Cochise County.

Department's Next Steps (if approved):

Once approved by the Board, the Department will forward the paperwork to the City of Tucson for their final approval, signature and funding.
 

Impact of NOT Approving/Alternatives:

Reduce drug crime prosecutors and support staff and jeopardize law enforcement drug grants.
