Adopt Zoning Ordinance 19-05 amending certain Zoning district boundaries from RU-4 (Rural one dwelling per four acres) to RU-2 (one dwelling per 2 acres), pursuant to the application of DCM Development.
Background:
The Applicant, DCM Development requested a Special Use Authorization and a Rezoning to approve a 9,100 square foot Dollar General store on the northwest corner of Burro Lane and Mescal Road, in the Mescal area.
On Wednesday, May 8, 2019, the Cochise County Planning and Zoning Commission (Commission) voted 6 – 0 to conditionally approve the special use SU-19-05 and unanimously recommended approval of rezoning Z-19-02 to the Board of Supervisors.
The Appeal period for the special use ended on May 23, 2019 and no appeal was received.
The Rezoning Application requests to change the zoning from RU-4 to RU-2. The rezoning is not required by the Zoning Regulations for the Special Use. The Applicant is requesting the rezoning because the store, drainage, and parking areas to not require the almost five acres. If the rezoning is approved, the lot can be split resulting in lots of no less than two acres reducing ongoing maintenance for Dollar General.
