Adopt Resolution 11-52 establishing forty-nine (49) elections precincts for Cochise County and defining their boundaries, effective March 1, 2012.

Background:

WHEREAS, A.R.S. § 16-411 states the Board of Supervisors of each county shall on or before December 1 of each year preceding the year of a general election, by an order, establish a convenient number of election precincts in the county and define the boundaries thereof; and

WHEREAS, A.R.S. § 16-412 states that for the purpose of conducting any election called pursuant to the laws of this state, precincts adopted under the provisions of A.R.S. § 16-411 shall become effective no later than March 1 of the year of the next general election; and

WHEREAS, at a hearing on November 21, 2011, the Board of Supervisors considered alternate scenarios for precinct boundaries; subsequent to that hearing the precincts within the Bisbee city limits have been modified to align with the City of Bisbee wards; the purpose of this Resolution is to document the scenario adopted by the Board of Supervisors at that hearing, with the modifications relating to the Bisbee wards,

NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:

1. The Cochise County Board of Supervisors hereby approves and declares the map attached in Exhibit “A” to be the Official Election Precinct Map for Cochise County.

2. That the Election Precincts shall be those set forth in the attached legal descriptions hereto as Exhibit “B” and incorporated by reference herein; and this designation shall be effective March 1 1, 2012.

File submission to the Department of Justice for review and approval.

Impact of NOT Approving/Alternatives:

Cochise County will not be in compliance with state redistricting requirements.

To BOS Staff: Document Disposition/Follow-Up:

Notify Elections Director and the County Recorder of Board action; record Resolution and provide copy to Elections Department for inclusion in the DOJ submission.
