Adopt Resolution 21-20 to authorize the addition of roads near the Highway 90 and I-10 interchange near Benson to the Cochise County Maintained Road System.

Background:

Arizona Department of Transportation (ADOT) acquired right-of-way for Dark Star Road, Vidal Trail and Calvary Lane as a part of the Highway 90/I-10 interchange project. The realignment of I-10 required the acquisition of several parcels for the creation of existing parcel access and the construction of roadways. The creation of these roads forms the infrastructure for the community North of the Highway 90/I-10 interchange. An agreement was made between ADOT and Cochise County to take these segments into Cochise County maintenance once the project was completed in 2014, but the ownership was not transferred. Because of this, ADOT is requesting Cochise County sign a waiver for the Four-Year Advance Notice of Abandonment and the Pavement Quality Report in accordance with A.R.S §28-7209. The Board of Supervisors may spend public monies for maintenance of public roads and streets other than legally designated state and count highways pursuant to A.R.S. § 28-6705(A1). Before spending public monies under this section, the roads or streets shall be laid out, opened and constructed in accordance with standard engineering roads specifications adopted by the Board of Supervisors without cost to the County. These asphalt roads have been built to county standards and ADOT has supplied Engineering reports and “as-builts” of the segments and it has been inspected by the County Engineer. With the information provided, the County Engineer recommends the adoption of these segments of road to the County Maintained Road system.

Department's Next Steps (if approved):

The new segment of Dark Star Road, Vidal Trail and Calvary Lane will be added to the County Maintained Road System Atlas.

Impact of NOT Approving/Alternatives:

This 1.51 miles will not be added to the County Maintained Road System. Cochise County will not be in compliance with A.R.S. § 28-7209.
