Approve Master Services Agreement between Cochise County, Cochise County Sheriff's Office and Off Duty Management for coordination of off-duty employment of Sheriff's deputies, effective May 10, 2022, for a period of two years, with two 1-year renewal periods.

Background:

The Sheriff's Office and most local and state law enforcement agencies across the country frequently participate in off-duty employment.  Our training and legal authorities as peace officers meet the needs of certain private businesses while achieving the mission of law enforcement, improving public safety.  Some examples include monitoring traffic in construction zones, escorting wide loads and providing security at various establishments.  Cochise County HR Policy 2219B authorizes Deputy Sheriffs to be employed in this capacity.

Traditionally, a Sheriff's Office employee would coordinate with the private businesses to schedule off-duty employment of deputies.  The Sheriff's Office is requesting the Board of Supervisors to approve a contract with Off Duty Management (ODM) to take over that function.  There is no cost to Cochise County for their services.  Their fee is paid by the business requesting an off-duty deputy.  They provide this service to various law enforcement agencies in Arizona and nationally.  They handle all aspects of off-duty employment such as notifications, scheduling, tax and payroll integration.  Their company ensures workman's comp and insurance liability concerns are covered.

The service agreement with Off Duty Management has already been reviewed by the County Attorney's Office.  The County Attorney's Office and Off Duty Management reconciled the contract.  The final version is attached for your review.

Department's Next Steps (if approved):

After BOS approval we will immediately schedule training with members of Off Duty Management and the Sheriffs' Office to begin utilizing their services.

Impact of NOT Approving/Alternatives:

Failure to approve the contract with Off Duty Management will mean the Sheriff's Office will continue to be responsible for coordinating deputy sheriff off-duty employment with private business.  This includes scheduling, checking liability coverage, helping with tax documents and troubleshooting any other issues associated with the off-duty employment.
