Approve the First Amended Intergovernmental Agreement (IGA) between the City of Douglas and Cochise County for Animal Shelter Services in Douglas, Arizona, effective July 1, 2022, at an annual cost of $60,126.34, to include an annual 3% increase for these services based on County demand beginning in FY2024.

Background:

Cochise County needs to provide animal shelter services in the unincorporated areas around Douglas in order to enforce state, county and local regulations relating to animals. The County has a long-standing IGA with the City of Douglas for these services. Over time, that IGA has become outdated and City shelter expenses have increased due to greater demand from the County Sheriff's Office Animal Control Officers. This amended agreement is consistent with the terms of the other County shelter IGA (City of Willcox) and increases the cost-share from the County.

The City of Douglas performed a study of the shelter operations over the past three years and found that the Sheriff's Department delivers 30% of the total animals held at the shelter. Therefore, the City is requesting the County cover 30% of the shelter operating costs, which equals $60,126.34 for FY23. This is an estimated $20,000 increase over previous years. The agreement includes annual increases of 3% starting in FY2024. Fluctuations of 10%, plus or minus, within the County-originated population for two successive quarters will result in an amendment to the annual compensation paid by the County. This stipulation protects the County should the portion of County-originated animals decrease due to population changes or the development of other shelter partnerships.

The Cochise County Sheriff's Office is aware of the fee increase for FY 23 and has incorporated this expense into the operating budget without requesting additional funds from the Board.

 

Department's Next Steps (if approved):

Approved IGA will be shared with CCSO to encumber the funds for future expenses in FY23.

Impact of NOT Approving/Alternatives:

The current IGA is outdated and City of Douglas may choose not to continue the agreement due to cost increases. This would be detrimental to CCSO operations for Animal Control as the only other shelter for ACO drop-offs is in Willcox.

The agreement is estimated to increase expenses for Animal Control shelter services by $20,000 in FY23. Per Commander Tom Alinen, this amount can be covered by reducting expenses in other areas of the CCSO operating budget.
