Approve or deny the Ocotillo Storage Appeal (SUA23-03), appellants Kathy Glidewell and Karen Mulholland, of the Planning and Zoning Commission's June 14, 2023 Meeting approval of Special Use SU23-12 (Ocotillo Storage).

Background:

The appellants, Kathy Glidewell and Karen Mulholland, have filed an appeal against a decision made by the Planning and Zoning Commission. At the June 14, 2023, meeting, the Commission unanimously approved a request (9-0) for Special Use Authorization from Caleb Malboeuf to establish a mini-warehouse (707.21) on a 15-acre parcel zoned R-36 (Residential, minimum 36,000 square feet) on APN: 123-09-010A near Benson.

Section 1716.04 of the Zoning Regulations states that appeals of Special Use decisions shall be heard by the Board of Supervisors at a duly noticed public hearing. Following its deliberations on the date of the decision, the Board of Supervisors shall either affirm, reverse, or modify the decision of the Planning and Zoning Commission.

 

Department's Next Steps (if approved):

The Department shall record the basis for the decision and shall provide a copy to the appellant, Special Use Authorization Applicant, and to the Planning Commission. Within 30-days of approval, the applicant must provide the case planner a signed Acceptance of Conditions form and a Waiver of Claims form. Prior to operation of the Special Use, the applicant shall apply for a building/use permit for the project. 

Impact of NOT Approving/Alternatives:

The Department shall record the basis for the decision and shall provide a copy to the appellant, Special Use Authorization Applicant, and to the Planning Commission. An approval of this appeal request would reverse the decision of the Planning and Zoning Commission and permit the special use request for guest lodging. A denial of this appeal request would affirm the decision of the Planning and Zoning Commission and not permit the special use request for guest lodging
