Approve Amendment 3 to the Title IV-E Interagency Service Agreement (ISA) between the Arizona Department of Child Safety (DCS), the Arizona Supreme Court, Administrative Office of Courts (AOC), and Cochise County for expenditure reimbursement related to child welfare dependency cases, effective upon signing by all parties.

Background:

The original Title IV-E Interagency Agreement was approved on March 26, 2020. The Title IV-E Foster Care program is a federal program administered through the Arizona Department of Child Safety. It allows counties to request reimbursement for allowable costs of attorneys providing legal representation to a Title IV-E eligible child and the child’s parents. Counties shall utilize at least 75% of the reimbursed dollars to support and enhance the delivery of child and parent legal representation in their jurisdiction. Reimbursement is calculated on a formula based on population factors and costs submitted by the county. Since 2020, Cochise County has averaged 20% reimbursement on costs submitted. 

The reimbursed funds have been used to provide dependency attorney training and updated software for improved case management. This updated amendment will continue the program for Cochise County. Changes surround the deadline for an anticipated projection of allowable costs to DCS.

Department's Next Steps (if approved):

The amendment to the agreement will be returned to DCS and IDC will continue to administer the program.

Impact of NOT Approving/Alternatives:

The county will not receive these partial reimbursements.
