Adopt Resolution 25-10 to authorize the abandonment of the 100 foot public right-of-way known as Jacobo Place located in the Townsite of Naco. 

Background:

The Engineering & Natural Resources department received an application from Renee D Reed requesting Cochise County to abandon a portion of a 100 foot wide public right-of-way, known as Jacobo Place, formally known as B Street, Naco Townsite, according to Book 1 of Maps and Plats at page 138, Office of the County Recorder, November 13, 2024. The applicant owns the surrounding parcels 102-57-308 and 102-57-311C and plans to combine the parcels and that portion of Jacobo Place into one. She is hoping it will lower her property taxes with regards to Special Districts . If the abandonment is granted, no current parcel would be denied legal access. There is an underground communications line that is located north of the northern boundary line of the proposed abandonment area and will not be affected. The department received one opposition letter/email from the Naco Sanitation District Chair stating that it should remain open for public use. The applicant has paid the $300 Administrative Action Fee and the Land Purchase Fee of $2,650. The land purchase fee is based on the current land values within the vicinity as set for tax assessment valuations with a 50% deduction based on the area that does not qualify as a buildable lot. The Cochise County Planning Manager and the 911 Rural Addressing MSAG Coordinator / SEACOM do not oppose the abandonment request. A site review confirmed that the road is not open for vehicle travel and is currently native desert with some vegetation.  

Department's Next Steps (if approved):

If the abandonment is approved, no further Board action is required. Upon recording of the Resolution and the Quit Claim Deed, the Right-of-Way agent will forward copies to the applicant. 

Impact of NOT Approving/Alternatives:

If the abandonment is not approved, the public right-of-way will remain public.
