Approve the King's Ranch at Coronado Right-of-Way Encroachment License Agreement between Cochise County and Kings Ranch, AZ LLC, effective immediately for a minimum of 5 years for the initial development phase.
Background:
King’s Ranch at Coronado was originally platted with private streets. Ownership changed several times and the current owners have worked closely with the County on a final plat amendment which provided for making the streets public, among other changes. Prior to this plat and ownership change, one phase of streets was built. This license agreement stems from that street and roadside drainage construction, as well as in response to the 2011 fires which had an impact on drainage across the site.
The license agreement provides for the owners of King’s Ranch at Coronado to temporarily maintain the shoulders and roadside drainage areas between the edge of pavement and edge of right-of-way. The license is beneficial to the County in that the owner agrees to maintain (at no cost to the County) the roadway shoulders and drainage for a period of five years in the initial development phase. This will allow them to deal with roadside drainage that was not constructed to County standard and that was damaged due to increased runoff with higher velocities after the fires, as well as mow the shoulder areas on a tighter schedule than the County would be able to.
The agreement provides for prior written approval of any construction within this area, but streamlines the process. It also allows the County to take over maintenance of the roads themselves while allowing more time for the roadside drainage to be addressed. It also provides for extending the agreement to future phases if both parties have found it beneficial. There is a termination clause. County’s attorneys have reviewed and approved the language of the agreement.

Department's Next Steps (if approved):
Once approved, agreement will be in place and the owners of King’s Ranch at Coronado will begin the maintenance of shoulders, roadside drainage and also mow while the County takes in these roadways (only) for maintenance.
Impact of NOT Approving/Alternatives:
Drainage improvements would immediately need to be made by the owners of King’s Ranch at Coronado in order for the County to take in these roads into maintenance and there would then be a cost to the County to maintain the shoulders, roadside drainage and mow the shoulders, for the next five years without this agreement.
