Adopt Resolution 13-12, altering the establishment and acquiring the right-of-way of Davis Road, a County Highway, at milepost 5.1 and 13.1, as described therein.

Background:

Recommendation: This department recommends that the accompanying resolution be adopted to alter the establishment of Davis Road, a County Highway, at milepost 5.1 and 13.1.

Background (Brief): Davis Road is one of Cochise County’s major collector roads and serves as the main route for traffic between State Route 80 and 191 from Tombstone to McNeal. This road has one of the highest accident rates in the county and, at times, is closed due to flooding. The department identified three locations with significant drainage issues at milepost 5.1, 9.9 and 13.1. Federal funds have been earmarked in order to improve these three locations on Davis Road. Two of the three locations, milepost 5.1 and 13.1 have progressed to the right-of-way acquisition phase.

Davis Road is currently established as a Declared County Highway, 66 feet in width, per Resolution 84-90. However, in order to perform the proposed improvements it is necessary to alter the established width from 66 feet to 200 feet and acquire the right-of-way for these two locations, to meet design standards appropriate for a high capacity, truck route and protect/maintain the drainage crossings. Further, at milepost 5.1, the curve centerline of the road will be slightly reduced in order to improve the alignment at this location.

The right-of-way for milepost 5.1 and 9.9 traverses nine privately assessed parcels and Arizona State Trust lands. Anticipated cost to acquire this right-of-way is approximately $250,000, the majority of which is for acquisition services. On September 26, 2011 (STP), March 6, 2012 (HPP) and December 18, 2012 (amendment 1), the Board approved IGA contracts and amendments with FHWA/ADOT to commit funds for right-of-way/construction activities.

Department's Next Steps (if approved):

Upon adoption of the resolution, staff will coordinate with Tierra Right of Way Services to acquire right-of-way. Once right-of-way is acquired and certified by FHWA/ADOT, the project can proceed to construction.

Impact of NOT Approving/Alternatives:

If the resolution is not approved, acquisition of right-of-way will be in conflict with state statutes. The County may be in violation of previous IGA’s and federal funding will be withdrawn.

Total funds set aside for the acquisition of all three locations is $505,000. The County’s match is 5.7% which equates to $28,785 and is provided through local HURF funds. After acquisition, remaining funds will be assigned to construction.
