Approve the IGA between Cochise County and the Tohono O’odham Nation on behalf of the Elfrida Water Improvement District to receive grant funds in the amount of $25,000 to purchase and install 100 water meters.

Background:

Under Proposition 202, which allows for Indian gaming on tribal lands in Arizona, tribes agreed to share a portion of their revenues with the State. 12% of the shared revenue is made available to cities, towns or counties for the purpose of benefiting the general public through either direct distribution or a deposit to the State’s Community Fund. The Tohono O’odham Nation has chosen to contribute directly to local governments.

Notice of this grant opportunity was shared throughout the State in April, 2013. The application requires any non-government entity to enter into an agreement with a city, town, or county that will accept the funds on their behalf. The entity that agrees to assist and receive the grant funds is required to enter into a Grant-in-Aid, or Intergovernmental Agreement (IGA) with the Nation. Although the Water District is a public water system and established as a special district, the Nation is requiring this IGA as part of their formal process.

The Elfrida Water Improvement District submitted a proposal for funding in May, 2013 and listed Cochise County as that entity on their application. The Water District proposal sought funding in the amount of $25,000 to replace 100 old and outdated water meters. This grant funding would enable them to complete their goal of replacing all the meters within a 5 year period.

On August 30, the Water District was notified by the Tohono O’odham Nation that their application was selected to be fully funded. Over 320 proposals were considered during this grant cycle.

This is a pass through grant. Cochise County will receive the funds and distribute them in a lump sum to the Water District. The Water District is responsible for complying with all requirements of the grant directly to the Tohono O’odham Nation. Cochise County will require copies of the final report submitted along with paid invoice copies for the water meters. Under the IGA the County is not allowed to collect a fee for this service. Management of the grant will remain the responsibility of the Elfrida Water Improvement District.

Department's Next Steps (if approved):

Follow up to ensure the IGA is fully executed by all parties. Act as a pass through entity to issue a check to the Water District, collect final report and receipts from the District for the water meters.

Impact of NOT Approving/Alternatives:

The Elfrida Water Improvement District will not receive funding in the amount of $25,000 and will not be able to complete their goal to replace 100 water meters
