Approve the revision of Sections 5.2, 6.1, 6.2, 6.2.3, 7.0, 8.1, 8.1.1, 9.8.2.3, and 13.6.1 of the procurement policy to reflect House Bill (HB) 2599, Procurement Reform Law, increasing the informal bid/sealed bid threshold limit from $50,000 to $100,000.

Background:

On September 13, 2013, HB2599 went into effect which raises the informal bid/sealed bid threshold limit to $100,000 from its current threshold of $50,000. Government agencies in Arizona are required to adopt these changes within their jurisdiction to become effective. Currently all acquisitions of $50,000 or more, by policy, require a sealed bid procurement process. Increasing the limit to $100,000 will provide the County a more streamlined and efficient process for the purchase of goods and services less than $100,000 and expedite the procurement process considerably as there will no longer be a requirement to advertise bids for 30 days that have an anticipated dollar amount of $100,000 or less. All purchases of $50,000 or more will still require the approval of the Cochise County Board of Supervisors.

Approval to implement HB 2599 will require the revision of specific procurement policies: 5.2, 6.1, 6.2, 6.2.3, 7.0, 8.1, 8.1.1, 9.8.2.3, and 13.6.1. These policies are attached with proposed revisions highlighted in red. The table of contents and definitions section of the policy will be revised as well and are attached.

Impact of NOT Approving/Alternatives:

The informal/sealed bid threshold limit would remain at $50,000.
