Adopt Resolution 11-15 to approve the appointment of Thomas W. Schelling as administrator of the Bowie Fire District.

Background:

Background (Brief): On December 2, 1957 the Bowie Volunteer Fire Company was declared organized with an elected fire chief and secretary/treasurer. In 1988 an election was held and the citizen of the fire district voted to reorganize the fire district and elect a three member governing board. In 2008 two seats were up for election on the governing board and E.O. “Ernie” Blandin and Bert Thomas Earven were both elected to serve a four year term. In 2010, Debra Juarez was appointed to the one seat open for elections, being the only candidate to file to run for that seat, a four year term. In 2010, Bert Earven was no long able to fulfill his duty as a governing board member after missing more than four consecutive meetings and was removed from the board by a vote of the other two board members. In March of 2011, Ernie Blandin passed away unexpectedly. Since a replacement for the vacant board seat had not been filled by Mr. Blandin and Ms. Juarez, with Mr. Blandin’s passing, only Ms. Juarez remained on the governing board resulting in a lack of a quorum. Pursuant to A.R.S. § 48-803(B), if the governing board is unable to fulfill its duties, the Board of Supervisors shall appoint an administrator to fulfill the same duties and obligations as set forth in A.R.S. § 16-226.

Department's Next Steps (if approved):

Next Steps/Action Items/Follow-up: Oath of Office will be administered and Thomas W. Schelling will assume the duties as administrator of the Bowie Fire District immediately. The Bowie Fire District will compensate Mr. Schelling according to the Special District Fees adopted by the Board of Supervisors effective July 1, 2010.

Impact of NOT Approving/Alternatives:

Impact of Not Approving: Without the appointment of an administrator, the Bowie Fire District would be unable to continue to operate, could face the possibility of the fire district being dissolved and impacting the safety and well being of the citizens living within the fire district.
