Adopt Resolution 11-30 to approve the appointment of Thomas W. Schelling as administrator of the Pomerene Fire District.
Background:
On September 17, 1979, the Pomerene Volunteer Fire District was declared organized with an elected three member governing board. On December 4, 2008, two governing board members, Loyd Sherman and Irene Brogan, were appointed to serve a four year term each. On August 24, 2010, as no candidate filed to run for the one board seat in the November 2, 2010 election, the Cochise County board of Supervisors cancelled the election and declared the Board position vacant pursuant to A.R.S. § 48-802(D)(4). In March 2011, Loyd Sherman passed away and left only one remaing governing board member, Irene Brogan, resulting in a lack of a quorum. Pursuant to A.R.S. 48-803(B), if a governing board is unable to fulfill its duties, the County Board of Supervisiors shall appoint an administrator to fulfil the same duties and obligations as set forth in A.R.S. §48-805.
Department's Next Steps (if approved):
Oath of Office will be administered and Thomas W. Schelling will assume the duties as administrator of the Pomerene Fire District immediately. The Pomerene Fire District will compensate Mr. Schelling according to the Special District Fees adopted by the Board of Supervisors effective July 1, 2010.
Impact of NOT Approving/Alternatives:
Without the appointment of an administrator, the Pomerene Fire District would be unable to continue to operate, could face the possibility of the fire district being dissolved and impacting the safety and well being of the citizens living within the fire district.
