Adopt Resolution 17-21 dissolving the Babocomari Road and Traffic Signal Improvement District.
Background:
On April 25, 2006, after receiving valid petitions from property owners, the Board of Supervisors adopted Resolution 06-36 establishing the Babocomari Road and Traffic Signal Improvement District. To assist in enabling improvements to the District, the County contributed approximately $469,312 to pay for partial engineering plans for the District. The intent of the District was to pay for additional engineering, construction of improvements, and other costs, through a sale of bonds. After the great recession, property values in the District dropped so that property values were insufficient to support bonds, and even after allowing for several years of recovery, property values have not risen sufficiently to support bonds.
The Board of Supervisors and staff have held numerous work sessions and other meetings with property owners to hear their concerns and expectations for the District, at which most property owners expressed a desire to dissolve the District. Given the prevailing desires of most property owners, and given that the District appears unable to meet the purpose for which it was formed, the Board of Supervisors, for itself and as the Board of the District pursuant to A.R.S. § 48-908, directed the County Attorney to prepare this resolution to dissolve the District. The Board further directed that the amounts paid by the County for engineering costs, and additional staff time and other costs, are deemed a contribution by the County to the District pursuant to A.R.S. § 48-921, and the County expressly waives any right to assess such costs against the District and property owners within the District. This is included in the resolution.
