Agenda Item Text:

Adopt Zoning Ordinance 11-03 reverting parcel 403-20-004E from General Business to R-18, pursuant to the application of Robert Burk.

Background:

The original purpose of the rezoning was to establish and operate an impound yard and vehicle repair shop. Mr. Burk submitted a commercial permit application for the vehicle repair shop in February 2009.

On June 3, 2008, the Board of Supervisors approved the rezoning request.  A one-year extension was administratively granted on May 5, 2009.  On June 29, 2010, the Board of Supervisors further extended this deadline to June 17, 2011.

Mr. Burk requested a reversion of the current GB zoning on June 23, 2011.

Department's Next Steps (if approved):

If approved, the Zoning will be reverted back to the R-18 status from the current zoning of General Business.

Impact of NOT Approving/Alternatives:

This Parcel will remain General Business, and the Applicant will be unable to comply with the Original Conditions of Approval for the rezoning of this parcel.

To BOS Staff: Document Disposition/Follow-Up:

After approval, Zoning Ordinance 11-03 will be signed and must be recorded.  A copy of the recorded document will be sent to the Planning Department.
