Approve Intergovernmental Agreement (IGA) 11-121, Amendment Two, between the State of Arizona and Cochise County adding federal funds to the Davis Road: Central Hwy to US191 project.

Background:

This project is located on Davis Road between Central Highway and US 191, extending slightly beyond both intersections.  A Coordinated Infrastructure Border (CBI) grant was awarded in 2011 for completing an assessment and preliminary design plans for Davis Road.  The Board of Supervisors approved IGA 11-121I on August 23, 2011 for the initial Project Assessment.  Amendment One was approved by the Board on August 28, 2012 to separate out the Davis Road: Central Hwy to US 191 portion for completing preliminary engineering and design plans for this two mile segment.

Right-of-Way needs for realigning the intersections for fright turning movements, for managing seasonal storm water flows and for future build-out conditions were identified.  State Transportation Program funds of $404,438 were awarded and approved in the SEAGO TIP towards Right-of-Way acquisition costs.  Obtaining Right-of-Way clearance would complete a shelf-ready construction project for this segment of Davis Road.

This second Amendment to IGA 11-121I will allow ADOT to add the additional federal funds to the Davis Road: Central Hwy to US191 Design Project.  This Amendment will also add the Right-of-Way acquisition activity to the project scope of work.  The Right-of-Way phase is anticipated to be completed within the next two years.

Department's Next Steps (if approved):

The signed IGA's will be transmitted to ADOT to be fully executed.  Once completed, ADOT will transmit invoices for the County's match funds and transfer the approved federal funds into an account for this project.  ADOT will then contract with a consultant team to complete the Right-of-Way acquistion scope of work for Davis Road: Central Highway to US 191. 

Impact of NOT Approving/Alternatives:

If not approved, awarded federal funds will not be added to the project and the Right-of-Way phase would not go forward at this time.   Right of Way clearance would not be obtained and the final design plans would not complete the ADOT/FHWA approval process.  Future acquisition of this segment of Davis Road may then occur at a later time with other funds.

Two signed copies should be returned to Jackie Watkins, County Engineer in the Hwy Dept.  A copy of the Clerk of the Court meeting action items should be forwarded to Jwatkins@cochise.az.gov  when completed.  A copy of the approved minutes of the August 14th meeting should also be forwarded to Jwatkins@cochise.az.gov after the August 28th meeting.  Jackie will transmit the fully executed IGA back to the BOS for filing.

Fiscal Impact & Funding Sources (if known):

Federal funds awarded $404,438. County Match is $24,446, with a placeholder over match of $116,116, pending re-programming an estimated $141,000 from federal funds being reimbursed to SEAGO from the Davis Road Milepost Right-of-Way phase into the Davis Road: Central Hwy to US191 Right-of-Way phase. In due time any unused County funds will be reimbursed back into the County's Davis Road project line item in the Hwy budget. $10,000 is being directed to oversight and review services from ADOT for the Davis Road: Central Hwy to US191 Final Design and Right-of-Way phases. County funding source is a combination of HURF, Flood Control and Capital Improvement dollars.

Available funds is showing only the line item in the Hwy budget set aside specifically for Davis Rd. federal projects.; additional funds are also available in budget line items for Right-of-Way Acquisition and Professional Services activities anticipated for FY19. Anticipated reimbursement of excess match funds from the completed Davis Road Milepost Right-of-Way phase will off-set the match requirements for this project (estimated $8,500).

There are no new impacts to the current fiscal year budget as this activity was planned and funds designated for this purpose. Maintenance activities for this segment of roadway are already part of the on-going activities and budgets of the Highway and Floodplain Depts. (now Public Works and Engineering).
