Accept a petition to establish 1 mile of Gleeson Road, as described therein, as a Declared County Highway, and schedule a Public Hearing for November 1, 2011.

Background:

Gleeson Road is the direct corridor which connects traffic from Tombstone, Gleeson, and Elfrida. The route consists of 2.3 miles of chip seal surface from Tombstone City limits east, then continuing east approximately 11.9 miles of native surface to Gleeson, and finally 9.6 miles of chip seal from Gleeson to State Route 191. Due to the importance of this route, and connecting these communities, over the past few years the County has continued to seek to improve the remaining native surface.

Per the 11/12 work plan a one-mile portion of Gleeson Road, from the Gleeson townsite heading west, is scheduled to be chip sealed. This portion was previously declared, however based upon direction from the Arizona Counties Insurance Pool, the Board of Supervisors approved Resolution 03-82 which rescinded the declaration status and designated the segment as a Primitive Road. In order to facilitate desired improvements, a 100 foot wide right-of-way was dedicated and now this segment must be established as a Declared County Highway. Therefore in accordance with state statutes a petition on was signed and verified requesting a public hearing. 10 signatures are required per statute and of the 12 signatures obtained 11 are valid as resident taxpayers. One signature obtained is a resident who is not listed as a property owner. This action before you today is acceptance of the petition and scheduling a public hearing in accordance with statutory requirement to establish this portion of Gleeson Road as a Declared County Highway.

Department's Next Steps (if approved):

Upon acceptance of the petition, a public hearing will be scheduled and advertised as required by statute.

Impact of NOT Approving/Alternatives:

That portion of Gleeson Road will remain designated as a Primitive Road and any improvements will be in conflict with State statutes.
