Agenda Item Text:
Approve Deeding Parcel #123-24-349, held by the County on Behalf of the State, to Rosa Amelia Maya Matthews.
Background:
A Benson real estate agent alerted Supervisor Judd about a potential title problem involving a recent purchase of a home in Benson by Ms. Rosa Amelia Maya Matthews: it appeared as though the driveway to the house was a separate tax parcel, and many years ago had been deeded to the State for failure to pay taxes. We confirmed that it had in fact been deeded to the State for failure to pay taxes. (The parcel never was successfully auctioned, probably because no one would want to purchase a sliver of property leading to someone's home). Right-of-Way Agent Teresa Murphy was able to determine that the driveway was a separate tax parcel due to an apparent mistake in the plat. To rectify this, the County Attorney is recommending that the County deed that parcel to Ms. Matthews, without auction or payment, as the parcel never should have been separate from the home, and Ms. Matthews had nothing to do with the problem that was created by the plat.
Department's Next Steps (if approved):
Execute the deed
Impact of NOT Approving/Alternatives:
The driveway parcel will continue to be separated from the residential parcel.
To BOS Staff: Document Disposition/Follow-Up:
Have Chairman Borer sign the deed, then record it and give the original to Britt Hanson, who will then send it to Ms. Matthews.
