Adopt Ordinance 050-21, amending Regulations and Licenses to Video Services Providers to Construct, Install and Operate Video Service Networks Along, Across, Under and Upon Highways in Cochise County, to Increase Fee from 3% to 5% of Licensee's Gross Revenue.
Background:
Arizona SB 2229, passed into law in 2018, declared Video Service Providers a matter of statewide concern. The law mandated local authorities to adopt an Ordinance and uniform licensing form for Video Service Providers. On March 10, 2020, the Cochise County Board of Supervisors approved Ordinance 050-20 establishing that Ordinance.
While licensing is required to be uniform across the State, management of right-of-way activities and local revenues associated with this type of use are preserved through each county’s ordinance provisions. Current law allows the County to charge a fee of up to five percent (5%) of the Licensee’s gross revenues. Ordinance 050-20 provides that the County’s fee is three percent (3%) of the Licensee’s gross revenues. In the best interest of the County and to be consistent with the fee charged by other Arizona counties, the proposed amended Ordinance increases the fee charged by the County to five percent (5%) of the Licensee’s gross revenue.

Provide the amended Ordinance to the Clerk of the Board and record the document with the County Recorder. Send a copy of the recorded document to the County Attorney’s Office.
Impact of NOT Approving/Alternatives:
The County will only collect a fee of 3% of gross revenue and will not be consistent with the fee collected by other Arizona counties on these Uniform Video Service Licenses.
