Approve Uniform Video Service License Agreement for Cable One, Inc., dba Sparklight, effective July 21, 2020 through July 20, 2030.
Background:
Arizona SB 2229, passed into law in 2018, declared Video Service Providers a matter of statewide concern. The law mandated local authorities to adopt an Ordinance and uniform licensing form for Video Service Providers. On March 10, 2020, the Cochise County Board of Supervisors adopted Ordinance 050-20 establishing that Ordinance.
Under Arizona Revised Statutes (A.R.S.) § 11-1912 allows incumbent cable operators to opt out of their current cable licenses and into the new Uniform Video Service License beginning in January 2020. Or, incumbent operators may choose to remain in their current license, until the license expires. Upon expiration of the current license, incumbent operators must apply for and obtain a Uniform Video Service License.
Cable One, Inc. dba Sparklight has applied for a Uniform Video Service License. Cable One previously held a Cochise County cable franchise local license, however, it expired on August 1, 2019, and was not renewed. Pursuant to A.R.S. § 11-1901(13), to be considered an incumbent operator, a cable operator or other video service provider on December 31, 2019, had to be providing video service in this state pursuant to a local license. Cable One’s local license expired on August 1, 2019. Therefore, Cable One dba Sparklight is not considered an incumbent operator under the statute and must apply for a new Uniform Video Service License in order to continue legally operating.

Have the Board Chair sign two originals of the Uniform Video Services License Agreement and give to the Clerk of the Board and record the document with the County Recorder. Send a copy of the recorded document to Christine Roberts in the County Attorney’s Office.
