Approve Consolidated Court Agreement with the City of Sierra Vista, effective July 1, 2020 through December 31, 2020.
Background:
Cochise County JP5 and the City of Sierra Vista Magistrate Court are currently consolidated via consolidated court agreements going back years. This consolidated court agreement will continue this partnership through December 31, 2020. In prior work-sessions, the Board had also advised they desire a new funding model for consolidated court agreement charges to the municipalities. County Administration and Sierra Vista City Administration are confident a new funding model and agreement will be presented to the Board this fall, to be effective January 1, 2021, if approved by both governing bodies.
Sierra Vista City Council is scheduled to vote on this exact agreement on September 10, 2020. This is the original agreement the Board sent to the City of Sierra Vista after the previous work-session. The only change made was to reflect the annual cost of $161,000 prorated for six months, which is the length of this current agreement.

Department's Next Steps (if approved):
Court continues to operated in a consolidated manner with City of Sierra Vista municipal court.
Impact of NOT Approving/Alternatives:
JP5 Court would be de-consolidated and the City would have to create their own municipal court. The County would lose a small amount of revenue. Yet, the revenue does not cover costs. If this agreement is not approved, the County would continue to operate the Court with a similar cost replacement percentage from fees/fines and a similar amount of general fund support.
