Discussion and possible direction regarding drainage issues along Old Pomerene Road in Benson, AZ.
This executive session is authorized under A.R.S. 38-431.03(A)(3) and (4), the Board of Supervisors may go into executive session for legal advice, and to discuss or consult with the public body in order to consider its position and instruct its attorneys regarding the public body's position regarding contracts that are the subject of negotiations, in pending or contemplated litigation or in settlement discussions conducted in order to avoid or resolve litigation.

Background:
In 2013, County Flood Control District (FCD) adjusted the drainage on a parcel that the Flood Control District owns along Old Pomerene Road. Said adjustment changed the flow of stormwater as it passes through downstream properties.
Department's Next Steps (if approved):
Engineering staff will proceed as directed by the Board.
Impact of NOT Approving/Alternatives:
Drainage issues will remain the same.
