Adopt Resolution 21-02 granting an amendment to the Water Services Franchise held by Liberty Utilities Corp. (Liberty), to expand the service area to include the area of the Sulger Water Company #2 Franchise.
Background:
Liberty acquired the assets of the Sulger Water Company #2 (Sulger) and has applied for an amendment to its Water Services Franchise to include the additional area; approximately 27 customers are being added to Liberty's customer base due to the acquisition of Sulger. Liberty has applied for and received approval by the Arizona Corporation Commission in the matter.
Sulger holds a Franchise for the area in question. Section 9 of the Sulger Franchise states, "This franchise may not be sold, leased, assigned, or conveyed without the express consent of the County, which consent shall not be unreasonably withheld."
The Acceptance of Franchise has been signed. The Notice of Public Hearing has been published three times as required by state statute. To date, there have been no letters or phone calls received either for or against granting the Franchise Amendment.
