Adopt Resolution 12-07 amending the provisions of the the Alternative Work Schedules section of the Human Resources Policy Manual for Elected Offices.

Background:

In 1993, the Board of Supervisors approved Resolution 93-102 establishing a new county-wide, flexible-time work policy, allowing the appointing authorities to implement a flexible work schedule for their employees. In 1994, Resolution 94-01 was approved by the Board amending the prior resolutions to the county-wide flexible-time work policy. These changes resulted in the Board establishing criteria for County employees on initial probation and employees working on a County observed holiday to credit eight (8) hours of the holiday time to their respective annual leave. On December 16, 2008, the Board of Supervisors approved Resolution 08-131 adopting the current Alternative Work Schedules policy which rescinded all previous resolutions referencing county-wide, flexible-time work policies.

On February 28, 2012, the Board of Supervisors met with Cochise County Elected Officers to review the proposed HR Policies. One matter requested by the Officers present was for the BOS to consider granting them authority to set employee work schedules without approval from the BOS or County Administration. Based on this discussion and staff’s understanding, the attached resolution has been brought to the BOS for consideration.

On March 13, 2012, the Board of Supervisors adopted the establishment of a Human Resources Policy Manual which incorporates all employee related personnel policies into one document. Included within the Human Resources Policy Manual are the provisions for Alternative Work Schedules.

The Human Resources Policy Manual is scheduled to become Effective April 1, 2012. Based on this and since the language in the Manual does not currently give Elected Officers the authority they requested to set their employee work schedules, staff is asking the BOS to consider Resolution 12-___. This Resolution will add language to the provisions of the Alternative Work Schedules section referencing ARS 23-391(B) stating that Elected Officers shall establish hours of operation for their elected offices in order to provide for essential public services and safety. Elected Offices shall have authority and flexibility to schedule employees in accordance with the established alternative work schedules set forth in the policy, without prior approval by the County Administrator, to adequately provide the essential public services and safety as needed while adhering to the regulations of the Fair Labor Standards Act (FLSA) for those employees designated as non-exempt.

Department's Next Steps (if approved):

If the amendment to the Alternative Work Schedules is approved, the next step is for the Human Resources Department to make this amended change to the Human Resources Policy Manual prior to distribution to the County workforce.

Impact of NOT Approving/Alternatives:

The Policies would continue to state that Elected Officers would be required to obtain approval from the BOS and County Administration for certain employee work schedules.
