Adopt Resolution 12-28 to adopt the Cochise County Sanitary Code, effective on and after July 24, 2012, thereby repealing Resolution 94-64 and adopt Ordinance 043-12 to specify the conditions and circumstances under which the Cochise County Sanitary Code can be enforced.
Background:
The Sanitary Code’s last update was July 1, 1994 and is in need of updating. Proposed changes include: 1) eliminate the Food Sanitation Certificate requirement; 2) adopt the USFDA Food Code (currently adopted the USFDA 1982 version); 3) consolidation of several regulations into one; and 4) adopt various Arizona Administrative Code articles, as amended, to comply with our delegation agreements with the Arizona Department of Health Services (ADHS) and Arizona Department of Environmental Quality (ADEQ). We project that revenue lost from the elimination of individual Food Sanitation Certificates will be offset by permitting establishments that are currently not permitted and from adding alternative septic systems to our delegation agreement with ADEQ.

Will publish and use for consultation and enforcement purposes.
Impact of NOT Approving/Alternatives:
Cochise County will remain statutorily “behind the times” and inconsistent with our delegation agreements with ADHS and ADEQ. This revision language will allow Cochise County to remain current with state rules as they change.
