Approve Amendment Three to the Arizona Department of Corrections (ADC) Lease Agreement No. 090098DC for renovation improvements to the Bisbee-Douglas International Airport (BDI) water system.

Background:

The current lease agreement with DOC to operate of a minimum and medium security prison on County owned land at the Bisbee-Douglas International Airport (BDI) will expire on November 8, 2012. On November 17, 2011, a preliminary engineering report was prepared by Brown & Caldwell to address renovation and expansion needs of the BDI water system. The estimated cost for a full completion of the water system upgrades is approximately $3.5 million. Following completion of the report it was determined that neither agency was in a position to fully fund the project, so it was decided that a phased approach would be implemented.

The items identified, which constitute the first phase of the project, are most critical to keeping the system operational; improving water quality; and providing the needed water capacity for prison operations. It was also determined that future phases of the project would be decided upon at a later date.

Amendment Three incorporates Phase I of the project which is estimated at a total cost of $286,000. The Arizona Department of Corrections has agreed to pay 87 percent of the total costs, in the amount of approximately $249,000.

Execute lease agreement amendment three. Issue a Notice to Proceed to the contractor. Monitor contract performance.

Impact of NOT Approving/Alternatives:

The BDI water system is in a critical state of needed repair. If repairs/upgrades are not done in a timely manner, complete system failure is eminent. A complete system failure will not only present operational problems for the prison, but it highly elevates public safety and liability concerns that may result from potential prison unrest. The Phase 1 improvements are critical to maintaining the integrity of the water system, and providing this much needed resource for continued prison operations.
